Assault Charges Against Watertown's Gus Bailey Dropped by Suffolk County Court

Despite the dismissal of charges, Bailey had to go to Federal Court this week for a change in his bail conditions for his federal drug case.

Assault charges against former Watertown Town Councilor Gus Bailey were dismissed by a Suffolk County judge after the alleged victim would not testify in the case.

Bailey appeared in Chelsea District Court on Sept. 20 for assault and battery charges in a case linked to his ex-girlfriend, Mary Coman. She is also a co-defendant in Bailey's federal drug case in which he allegedly was growing marijuana in a Waltham warehouse and selling it.

The case was dropped when Coman exercised her Fifth Amendment rights and did not testify, according to Renee Nadeau Algarin, deputy press secretary for the Suffolk County District Attorney's Office.

Although charges were dropped, Bailey had to appear in Boston Federal Court on Monday in connection to the assault charges. A Federal Court judge changed the conditions of his release on bail to include that he is not allowed to be in Essex County, where Coman now lives.

Bailey was released on a $25,000 bond. He was arrested in October 2011 on the drug charges, and the case moved to federal court in December 2011.
