Watertown Man Caught with Heroin at Mall in Marlborough

Three people have been charged with heroin and crack cocaine possession after one was caught shoplifting.

Police responded to a report of shoplifting Tuesday, Feb. 26, but ended up leveling charges of drug possession against three people.

Police were called to JC Penney at the Solomon Pond Mall on Tuesday after a woman who was later identified as Courtney Elizabeth O'Reilly, 33, of 53 Alder Street in Waltham was detained for allegedly taking a Keurig Coffee maker and a pack of coffee and tea.

Police interviewed the woman and discovered she had produced a stolen New Hampshire drivers license when she had been detained and maintained that identity while being interviewed by police.

Police were able to locate another man, later identified as Richard Gaudet Jr., 34, of 53 Alder Street Waltham, on Donald J. Lynch Boulevard that had allegedly been an accomplice to the crime. He was carrying a backpack he said was given to him by Meran Nshanian, 36, of 10 Wells Ave Watertown who had left the area.

In the bag, police reported finding multiple I.D. cards (three of which were found to be stolen), a straw with what they believed to be cocaine residue on one end and a hypodermic needle loaded with a brown liquid believed to be liquid heroin as well as a baggie with what is believed to be heroin residue. Police also found a glass pipe.

"This pipe had burnt residue I believe through my training and experience to be crack cocaine," wrote Marlborough Police Officer Paul Connors in his report of the incident.

After an investigation, it was found that O'Reilly, Gaudet and Nshanian had worked together, according to the police report. When she was searched, O'Reilly was found to have a glassine baggy corner with residue believed to be heroin, according to court documents.

At the time of his arrest, Gaudet was out on bail on multiple charges, including 8 counts of breaking and entering at night for a felony in Waltham. According to court documents, he has a record — that includes Assault with a Dangerous Weapon and Asssault and Battery — dating back to a 1993 charge. O'Reilly was also out on bail, according to court records, on charges of breaking and entering and larceny and has a record dating back to a 1997 juvenile charge.

O'Reilly was charged with shoplifting by asportation, forge or misuse an RMV document, conspiracy to violate a drug law, conspiracy, drug possession Class A, two counts of drug possession Class E, drug possession Class B and two counts of receiving stolen property under $250.

Nshanian was charged with conspiracy to violate a drug law, conspiracy, drug possession Class A, two counts of drug possession class e and drug possession Class B.

Gaudet was charged with conspiracy to violate a drug law, conspiracy, drug possession class a, two counts of drug possession Class E, drug possession Class B and two counts of receiving stolen property under $250.

All were released on bail Wednesday. O'Reilly and Gaudet were released on $1,000 bail and had their bail from Waltham revoked.
