Gus Bailey and his co-defendants in the marijuana distribution case may be moving to a jury trial in Boston Federal Court.
It appears former Watertown Town Councilor Thomas "Gus" Bailey will have his day in court as a date has been set for a jury trial in the federal drug case involving Bailey and his five co-defendants. Boston Federal Judge Ryan W. Zobel will preside over the trial, which is scheduled to start on May 13, 2013, according to federal court documents. The court date does not guarantee the case will actually go to trial, but is the first step in the process. The defendants could change their pleas to guilty and forgo a trial. Attorneys for Bailey and his co-defendants – Clay Gollobin, Eric Falzon, Mary Nicole Coman, Matthew Fox, Barbara Waldman – have until Jan. 30, 2013 to file motions to suppress in the case. Assault charges against former Watertown Town Councilor Gus Bailey were dismissed by a Suffolk County judge after the alleged victim would not testify in the case. Bailey appeared in Chelsea District Court on Sept. 20 for assault and battery charges in a case linked to his ex-girlfriend, Mary Coman. She is also a co-defendant in Bailey's federal drug case in which he allegedly was growing marijuana in a Waltham warehouse and selling it. The case was dropped when Coman exercised her Fifth Amendment rights and did not testify, according to Renee Nadeau Algarin, deputy press secretary for the Suffolk County District Attorney's Office. The former Watertown Town Councilor faces federal drug conspiracy charges linked to a warehouse in Waltham where he allegedly grew marijuana.
Former Watertown Town Councilor Thomas “Gus” Bailey was back in Boston Federal Court Monday after being arrested on an assault and battery he allegedly committed on an ex-girlfriend and co-defendant in the marijuana distribution case in which he is charged. Federal Court Judge Robert B. Collings released Bailey on a $25,000 bond after changing the conditions of his release to restrict Bailey from entering Essex County, where co-defendant Mary Coman now lives. The pair has a son, but he no longer resides with Coman, according to Federal Court documents. The court ordered Bailey not to have any contact with Coman. Three people charged with money laundering in connection with the alleged Waltham pot-growing ring pleaded not guilty on at the John Joseph Moakley Courthouse in Boston on July 13, according to court documents. The former District B Town Councilor facing marijuana trafficking charges was a family man, but had dropped out of town politics for a few years.
Former colleagues of Gus Bailey said they were stunned when they heard that the former Watertown Town Councilor had been arrested in a major marijuana bust. Bailey, who owns a home on Marshall Street, was arrested with two others on Wednesday at a Waltham warehouse filled with 700 marijuana plants, 100 lbs. of loose marijuana and $20,000 in cash. Bailey has no prior criminal record, according to his attorney, Charles Bookman. Town Council President Mark Sideris said he not only worked with Bailey on the Town Council, but also knew him through youth sports. “It just surprising.
